Thank you for choosing BreathePro.com. By using the services on BreathePro.com, you are agreeing to the following terms with BreathePro.com and the general principles for the website and affiliates. Prior to using BreathePro.com website and services, you must read and accept all of the terms and conditions in this Agreement.
The Food and Drug Administration (FDA) classify CPAP/BiPAP/Bi-Level machines, complete assembled CPAP masks, humidifiers, and Oxygen Concentrators as Class II Medical Devices that require a copy of the prescription be on file prior to shipping your order to any U.S. address. You may order any Class II Medical Device prior to submitting your prescription; however, it will only ship once the prescription is on file. There are multiple ways to submit your prescription; upload your prescription through our online Prescription Upload Portal, fax your prescription to 1-888-496-3160, or email email@example.com.
BreathePro.com will exchange items due to a manufacturer’s defect at no charge for the same item while the item is still covered by the manufacturer’s warranty. Customers should contact BreathePro.com via the “Contact Us” section of the website. Please provide your name/name of purchaser and order number and explain the nature of the defect. A BreathePro.com representative will review your case and provide further information to remedy the situation.
Warranty repairs or replacement decisions are made solely by the manufacturer. All machines (CPAP/Bi-Level/Oxygen Concentrator, etc.) experiencing functional issues that are no longer covered by the manufacturer’s warranty MAY be repaired by the manufacturer. This policy varies by manufacturer and MAY require a diagnostic fee, which may or may not be applied to the actual repair cost and will be collected prior to submitting the machine to the manufacturer for assessment.
BreathePro.com will accept returns on any unopened item(s) within 30 days of the original ship date. Opened item(s) may not be returned. Refunds will be paid in the original form of payment and will be issued when the item(s) are received into our facility and examined. Unless otherwise noted, a 15% restocking fee will be subtracted from the original cost and a credit for the difference will be issued. Shipping costs are not refundable. These terms do not apply to exchange items due to manufacturer’s defect.
To Return A Purchase: Customers should submit a Return Request. A BreathePro.com representative will review your case and provide a Return Number. Items may not be returned without an authentic Return Number.
To avoid returns, we recommend that you take precautionary measures to insure you are purchasing the correct items, styles, and/or sizes. BreathePro.com makes available a detailed product page and mask sizing gauges (when available) for your convenience.
Canceling an Order
There will be a 5% cancellation fee for any orders placed that are cancelled before it ships out. Your order is considered accepted once you have provided payment information and submitted your order. If you elect to cancel your order at any time a 5% cancellation fee is applicable; your payment will be credited back to you minus 5% of the charge. In the event you must cancel an order because you cannot obtain a copy of your prescription; contact BreathePro.com via “Contact Us” section of the website. We will try our best to help you obtain it.
Use of BreathePro.com
While using BreathePro.com, you will not:
- Register or use any email address that you do not own or for which you do not have the express permission of the owner to register with.
- Duplicate, change, or disseminate content and our copyrights and trademarks; gather, compile, or in any way collect information about users, including email addresses, without first obtaining such user’s express consent;
- Use BreathePro.com, if you are below the age of 18 and/or if you are unable to form legally binding contracts.
- Manipulate the list price of any product, service or item listed on the website www.BreathePro.com
- Distribute or post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters or pyramid schemes;
- Impersonate any person or entity, including without limitation a BreathePro.com employee or agent, or other misrepresent your affiliation with any person or entity;
BreathePro.com has the right to suspend, deactivate, limit, or cancel our service and user accounts, impede or restrict access to our website is our sole discretion. BreathePro.com reserves the right to refuse service to anyone. Should this occur, we will continue to provide warranty and other related services as required by law; however, we will not sell any further products to such customer.
You recognize and agree that the content made available at BreathePro.com is for informational purposes only and is not intended to be taken and should not in any way be construed as medical advice or counseling or as the practice of medicine. Users should never use BreathePro.com resources in place of seeking professional advice from a licensed medical practitioner. We make no guarantees, promises, or predictions of success regarding any of the products, services or resources offered at BreathePro.com.
You agree to release BreathePro.com, trustees, officers, agents, directors, subsidiaries, joint ventures and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, real or imaginary, arising out of in any way connected to a dispute with BreathePro.com.
Risk of Loss
All items purchased are made pursuant to a shipment agreement. This means that the risk of loss and title for such items pass to you upon our delivery to the carriers (FedEx, UPS, DHL, USPS, etc.).
In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, BreathePro.com shall have the right to refuse or cancel any orders placed for the product or service listed at the incorrect price. BreathePro.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, BreathePro.com shall issue a credit to your credit card account in the amount of the incorrect price.
Health Insurance Information
BreathePro.com currently does not accept Health Insurance and is not contracted with any Health Insurance carriers. BreathePro.com does not file any health insurance claims for any reason. You may be eligible to submit a claim to your provider on your own behalf if you have out of network benefits. We will do our best to provide billing codes to make these submissions; however, this is not a guarantee of payment.
BreathePro.com sells respiratory related equipment including sleep apnea products to customers for cash/credit charge. We are a private pay site. We do not work with private or government based insurers or social benefit programs. BreathePro.com is not a Medicare provider nor do we have a contract with Medicare to provide services. Medicare will not reimburse you for your purchases you made through BreathePro.com.
Notice to Medicare Beneficiaries and Patients with Other Insurance Coverage Seeking to Place Orders through BreathePro
Medicare, insurance companies and other payors may not pay for many of the items offered for purchase through BreathePro.com and you will have to pay for those items out of your own pocket. If you believe an item on BreathePro.com may be reimbursable through your insurance policy or coverage, please contact your insurance company prior to placing your order.
